Welcome to Texas Iberico. These Terms of Service (“Terms”) govern your access to and use of texasiberico.com (the “Site”), all associated content, and any products or services offered by Texas Iberico (collectively, the “Service”).
By accessing the Site or purchasing from us, you agree to be bound by these Terms, including the additional policies referenced herein. If you do not agree to these Terms, please do not access or use the Site.
1. Acceptance of Terms
By using the Site and/or completing a purchase, you agree to these Terms and any additional policies posted on the Site, including our Privacy Policy, Refund Policy, and Shipping & Returns Policy, each of which is incorporated by reference. These Terms constitute a binding agreement between you and Texas Iberico.
2. Eligibility and Account Terms
You represent and warrant that you are at least the age of majority in your jurisdiction and are legally capable of entering into binding agreements. You agree to provide accurate, current, and complete information when creating an account or placing an order.
3. Use of the Service
You agree to use the Site for lawful purposes only. You may not:
- Violate any applicable laws or regulations
- Interfere with the security or operation of the Site
- Upload or distribute viruses, malware, or harmful code

4. Products and Orders

Our products are perishable food items. You acknowledge that proper handling and storage are required, and you assume responsibility for product care once delivery is completed.
5. Payment and Billing
By submitting an order, you authorize Texas Iberico and its payment processors to charge your selected payment method. Payment must be received before an order is processed.
All prices are listed in U.S. dollars and exclude applicable taxes and shipping fees unless stated otherwise. You agree to keep billing and contact information accurate and up to date.
6. Shipping and Delivery
Shipping timelines provided on the Site or during checkout are estimates only. Once products are delivered to the carrier, title and risk of loss pass to you.
Texas Iberico is not responsible for carrier delays, weather conditions, theft, or events beyond our control. Please review our Shipping & Returns Policy for additional details.
7. Refunds and Returns
Due to the perishable nature of our products, all sales are final except as expressly stated in our Refund Policy.
Refunds or replacements may be offered at our discretion for damaged, defective, or incorrect products when reported within the required timeframe.
8. Food Safety and Handling
All products are produced and sold in compliance with applicable USDA and state food safety regulations. Texas Iberico is not responsible for spoilage, damage, or safety issues resulting from improper handling, storage, or preparation after delivery.
9. No Medical or Health Claims
Statements regarding nutritional or health benefits have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.
10. Intellectual Property
All Site content, including text, images, graphics, logos, and product descriptions, is the property of Texas Iberico or its licensors and is protected by U.S. and international intellectual property laws.
You may not copy, reproduce, distribute, or use Site content without express written consent.
11. User Content
If you submit content to the Site, including reviews or comments, you grant Texas Iberico a royalty-free, perpetual, irrevocable, and worldwide license to use, display, reproduce, and distribute such content.
You represent that your submissions do not violate third-party rights or applicable law.
12. Prohibited Conduct
You agree not to:

- Post harmful, misleading, or offensive content
- Collect personal data from other users
- Use automated tools such as bots or scrapers
- Attempt to bypass or interfere with Site security features

14. Disclaimer of Warranties

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXAS IBERICO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
IN NO EVENT SHALL TEXAS IBERICO’S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Certain jurisdictions, including California, may limit these exclusions. They apply only to the extent permitted by law.
16. Indemnification
You agree to indemnify and hold harmless Texas Iberico, its owners, officers, employees, and affiliates from claims arising from your violation of these Terms or applicable law.
17. Arbitration and Dispute Resolution
Disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in Bexar County, Texas. You waive the right to a jury trial and class actions.
You may pursue claims in small claims court where applicable.
California Residents: You may opt out of arbitration by emailing howdy@texasiberico.com within 30 days of your first purchase.
18. Force Majeure
Texas Iberico is not liable for delays or failures caused by events beyond reasonable control, including acts of God, natural disasters, labor disputes, pandemics, government actions, or transportation failures.
19. Governing Law
These Terms are governed by the laws of the State of Texas.
California Residents: Nothing herein limits rights under the California Consumer Legal Remedies Act (CLRA) or other applicable laws.
20. Changes to These Terms
We may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated Terms.
